Petition Declaration
Recognition and Registration of a foreign divorce in Malaysia
Your divorce order from another country does not automatically take legal effect here.
A Petition Declaration allows the Malaysian court to recognise and register a foreign divorce decree.
What Is a Petition Declaration
For non-Muslims, a Petition Declaration is a court application to declare that a divorce obtained outside Malaysia is valid and recognised under Malaysian law.
Once granted, the declaration allows the foreign divorce to be legally acknowledged for official and administrative purposes in Malaysia.
When Is a Petition Declaration Required
You may need to apply for a Petition Declaration if:
Your divorce was obtained overseas
The marriage was registered in Malaysia
You need the divorce to be legally recognised in Malaysia
You intend to remarry or update official records
Without this declaration, the foreign divorce may not be recognised locally.
What the Court Will Consider
In a Petition Declaration application, the court generally considers:
Whether the foreign divorce was lawfully obtained
The jurisdiction where the divorce was granted
Compliance with applicable legal requirements
Each application depends on its facts and supporting documents.
