Recognition and Registration of a foreign divorce in Malaysia

What Is a Petition Declaration

For non-Muslims, a Petition Declaration is a court application to declare that a divorce obtained outside Malaysia is valid and recognised under Malaysian law.

Once granted, the declaration allows the foreign divorce to be legally acknowledged for official and administrative purposes in Malaysia.

When Is a Petition Declaration Required

You may need to apply for a Petition Declaration if:

  • Your divorce was obtained overseas

  • The marriage was registered in Malaysia

  • You need the divorce to be legally recognised in Malaysia

  • You intend to remarry or update official records

Without this declaration, the foreign divorce may not be recognised locally.
